These Terms of Service govern the use of the Merci Beauté online store and purchases made from MERCI CONCEPT SIA.

1. Scope of these Terms

By using our website or placing an order, you agree to these Terms together with the policies referred to in them, including our Privacy Policy and Refund Policy.

Nothing in these Terms limits or excludes rights that consumers have under mandatory applicable law.

Our online store is hosted on Shopify, which provides the ecommerce platform used to offer our products and process orders.


2. Eligibility and customer accounts

You may browse the website regardless of age.

If you do not have legal capacity to enter into a binding purchase contract, an order must be placed with the involvement or consent of a parent, guardian or other legal representative where required by law.

If you create a customer account, you are responsible for providing accurate information and for keeping access to your account secure. Please contact us if you believe your account has been used without authorization.


3. Products and product information

We aim to describe and display our products accurately. Product colours may appear differently depending on your screen or device.

Packaging, presentation or other non-essential product details may occasionally change where this does not materially alter the product ordered.

We may update or discontinue products for future orders. This does not affect orders already accepted by us or any statutory consumer rights.

Product information on the website is provided for general consumer information and should be read together with the information and instructions supplied with the product.


4. Orders and formation of the contract

When you place an order, you submit an offer to purchase the products in your cart.

We may send an automated acknowledgement confirming that we have received your order. A purchase contract is formed when we accept the order, normally by sending an order confirmation, unless that communication clearly states otherwise.

We may refuse or cancel an order where there is a legitimate reason to do so, for example if:

  • a product is unavailable;

  • there is an obvious pricing or product-information error;

  • payment cannot be authorised;

  • we reasonably suspect fraud or misuse;

  • delivery to the requested destination is unavailable;

  • applicable purchase limits have been exceeded; or

  • we are legally required to do so.

If we cancel an order after payment has been received, we will refund the relevant amount.

Once an order has entered processing or shipment, operational cancellation may no longer be possible. This does not affect any statutory right of withdrawal or other consumer rights available under applicable law.


5. Prices and payment

Prices are shown in EUR and include applicable VAT unless expressly stated otherwise.

Delivery charges and any other applicable charges are shown before the order is submitted.

We may change prices for future purchases at any time. Price changes do not affect orders already accepted by us.

Payments are processed using payment service providers made available at checkout. You must provide accurate billing and payment information and be authorised to use the selected payment method.

If an obvious pricing error occurs, we may contact you before accepting or fulfilling the affected order. Your statutory rights are not affected.


6. Shipping and delivery

Available delivery methods, charges and estimated delivery times are displayed during the shopping or checkout process.

We aim to deliver orders within the timeframe communicated to you. Delivery dates are estimates unless a specific date has been expressly agreed.

If delivery is delayed or does not take place, your statutory rights regarding late or non-delivery remain unaffected.

Risk of loss or damage remains with us until you, or a third party designated by you other than the carrier, takes physical possession of the goods, except where applicable law provides otherwise.


7. Right of withdrawal, returns and refunds

Consumers purchasing online may have a statutory right to withdraw from the purchase within 14 days without giving a reason, subject to the conditions and exceptions provided by applicable law.

Details about withdrawal, hygiene-related exceptions, return shipping, damaged or incorrect goods and refunds are set out in our Refund Policy.

Nothing in our Refund Policy limits statutory rights relating to defective or non-conforming goods.


8. Statutory conformity rights

Products sold to consumers are subject to the mandatory legal guarantee of conformity and other consumer protections that apply under EU and national law.

These rights exist independently of any commercial guarantee and independently of the 14-day right of withdrawal.

Where a product is defective or does not conform to the contract, consumers may be entitled to remedies such as repair, replacement, price reduction or termination of the contract, depending on the circumstances and applicable law.


9. Acceptable use of the website

You must not misuse the website, attempt to interfere with its security or operation, introduce malicious code, use the website for unlawful purposes, or infringe the rights of MERCI CONCEPT SIA or third parties.

We may restrict access where reasonably necessary to protect the website, our customers, our rights or the integrity of our services.


10. Intellectual property

Unless otherwise stated, website content including text, graphics, branding, photographs, design elements and other materials belongs to MERCI CONCEPT SIA, its licensors, suppliers or other rights holders and is protected by applicable intellectual property laws.

You may use the website for personal, non-commercial shopping purposes.

You may not reproduce, distribute or commercially exploit protected content without authorization from the relevant rights holder, except where permitted by law.


11. Third-party services and links

Our website may use or link to third-party services, including payment, delivery, review, analytics, marketing and social-media services.

Third parties may operate under their own terms and privacy notices.

Nothing in this section excludes responsibility that we have under mandatory law for service providers used by us to perform our obligations to you.


12. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, and nothing affects mandatory consumer rights.

To the extent permitted by applicable law, we are not responsible for losses that were not reasonably foreseeable when the contract was concluded, or for losses arising from events outside our reasonable control, provided this does not remove rights or remedies that mandatory law gives to consumers.

The website may occasionally be unavailable for maintenance, technical issues or circumstances outside our reasonable control. We will take reasonable steps to restore access where practicable.


13. Complaints and dispute resolution

If you have a complaint, please contact us first at contact@mercibeaute.com and describe the issue and the solution you are requesting.

We will handle consumer complaints in accordance with applicable law.

Under Latvian consumer-protection procedure, a trader generally provides a reasoned response to a written consumer complaint within 15 working days.

If a dispute cannot be resolved directly, consumers may contact the Latvian Consumer Rights Protection Centre (PTAC) for assistance and, where applicable, use the Consumer Dispute Resolution Commission or another competent out-of-court dispute-resolution body.

Consumers may also use other remedies or competent courts available under applicable national or EU law.


14. Governing law

These Terms are governed by the laws of the Republic of Latvia.

If you are a consumer residing in another country to which we direct our commercial activities, this choice of law does not deprive you of mandatory consumer protections that apply under the law of your country of habitual residence.


15. Changes to these Terms

We may update these Terms from time to time for legal, regulatory, security or operational reasons.

Updated Terms apply prospectively from the date they are published and do not alter the terms applicable to orders already concluded, unless a change is required by mandatory law.


16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
